January 12

Only one item, which did not impact historical property.

1. Request for rezoning of part of a parcel at 1901 Western Avenue Behind Southern Community College, near Sunrush). The parcel is zoned C-4, and will be a self-storage complex. The owner (First Capital Storage) wants to use part of it as a residence for a 24 hour security of the facility. The city recommended that it be rezoned the same residential zoning level as the neighboring residential area. Two neighbors were present, and did not speak in opposition.

   Passed without opposition.

   Since this was a division of a pre-existing zoning area, legal counsel for First Capital Storage (Jim Cutright) explainined that the concept of "Spot Zoning" does not apply in this case. He explained that Spot Zoning occurs when a government restrictively zones part of a property so that the owner cannot use it, and is thus considered a "taking" of property rights.
